Please read these Terms of Service ("Terms") carefully before using WebSkySpace's website and hosting services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By signing up for or using WebSkySpace services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are acting on behalf of a company, you confirm you have the authority to bind that company.
2. Services Provided
WebSkySpace provides cloud web hosting services on a month-to-month basis. Current pricing is R100 per month per hosting account. Services include web server hosting, domain pointing assistance, and basic technical support via WhatsApp.
3. Payment and Billing
- Payment is due monthly in advance.
- Failure to pay within 7 days of the due date may result in service suspension.
- Accounts suspended for non-payment for more than 30 days may be terminated and data deleted.
- All prices are in South African Rand (ZAR) and are subject to change with 30 days' notice.
4. Cancellation Policy
You may cancel your hosting account at any time by notifying us via WhatsApp at +27 60 867 2154. Cancellations take effect at the end of the current billing cycle. No refunds are provided for partial months.
5. Acceptable Use
You agree not to use WebSkySpace services to host or transmit:
- Illegal content of any kind under South African or international law.
- Malware, spyware, viruses, or any harmful software.
- Spam or unsolicited bulk email.
- Content that infringes on intellectual property rights.
- Phishing pages or fraudulent content.
Violation of this policy may result in immediate account termination without refund.
6. Uptime and Service Availability
We strive to maintain 99.9% uptime. Scheduled maintenance will be communicated in advance where possible. WebSkySpace is not liable for losses arising from unplanned downtime beyond our reasonable control (e.g., DDoS attacks, infrastructure failures by third-party providers).
7. Data and Backups
While we take reasonable precautions, it is your responsibility to maintain backups of your website data. WebSkySpace is not liable for data loss. We recommend keeping regular independent backups.
8. Limitation of Liability
To the maximum extent permitted by South African law, WebSkySpace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including loss of data, revenue, or business opportunities.
9. Intellectual Property
You retain full ownership of content you upload to your hosting account. WebSkySpace retains ownership of all branding, website design, code, and materials created by us.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. We will notify active clients of significant changes via WhatsApp.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
